What has been the highlight of your practice over the past 12 months?

We advised on the establishment of a private trust company structure for an ultra-high net worth individuals with complex constitutional arrangements at all levels to allow the settlor (and thereafter various family members) to retain a high level of oversight over all aspects of the structure. Sadly, the settlor has since passed away and oversight of the structure has passed to the successor family members.

Carey Olsen's role: Over a period of two months, Carey Olsen advised on and drafted complex bespoke documents for all Jersey aspects of the structure, including the transfer of substantial assets into the structure.

Significance of matter: Ultra-high net worth clients from the Middle East often wish to retain a high level of oversight and control over their wealth holding structures, which usually requires complex and bespoke drafting. Carey Olsen has a strong reputation for bespoke drafting and has a team that is large enough to turn around even the most complex of instructions within a tight timeframe.

What has been the highlight of your practice over the past 12 months?

Completing the restructuring of a Jersey trust structure for a European family; the main assets are business-related, including a company owned by the family for 10 generations. The structure will enable the assets to stay in trust for several generations to come. The work took around 13 months and was particularly satisfying because it created an ultimately sustainable structure.

What advice would you give rising stars/new lawyers in the private client world?

Firstly, to take the time to get to know the family that you are advising and to understand what their goals are and what motivates them. Secondly, to see yourself as part of a team and to fully embrace working with the other advisers in other jurisdictions.

What has been the highlight of your practice over the past 12 months?

I was due to go to trial last year on a matter (a claim to recover what my client alleged were the concealed proceeds of a fraud which we said were held on trust for it) which, in one form or another, had been on-going for more than a decade. The matter settled two days into the trial window. It could have been frustrating not to get to argue the case in court, given all the preparation had been done, but it was fantastic for the client to finally bring the matter to a satisfactory conclusion.

What advice would you give rising stars/new lawyers in the private client world?

Understand your clients and what is important to them. On the contentious side, be aware that litigation in trusts and private wealth matters can involve considerations and issues that often don't feature at all in commercial litigation.

What has been the highlight of your practice over the past 12 months?

I appeared as expert witness in O’Keefe v Caner, an English case concerning the limitation period for claims against directors. I was cross-examined by the former Attorney General, Lord Goldsmith QC and Anthony Zacaroli QC for the opposing applicants. The claims brought by Memery Crystal on behalf of the Applicant Liquidators related to allegations of breaches arising from unauthorised payments by way of dividend amounting to some £35 million. The firm was instructed by Enyo Law LLP.

What advice would you give rising stars/new lawyers in the private client world?

The best approach is to throw away preconceptions. Do not make plans, because life never goes to plan. The key is how you react to the unexpected. Make the most of every opportunity. Be open to difference. Cherish adverse experiences as you learn the best from them.

What has been the highlight of your practice over the past 12 months?

Highlights include an extended piece of work involving the complete restructuring of a very wealthy family's holdings to modernise the structure and to adapt to generational change.
I have dealt with various pieces of litigation with trusts under attack to resolve disputes and to allow families to move forward.
Above all, I have been leading and growing a fantastic team which is now the largest of its kind in the Channel Islands.

Be adaptable. It is a changing world out there, and events over the last decade have brought that message home. You need to be able to cover all areas and deliver real value to clients and to do that you absolutely must get to know your clients properly.

What has been the highlight of your practice over the past five years?

The highlight of my practice for the last 5 years has been my involvement (since September 2013) in the Campbell v Campbell case, with proceedings in the BVI, Hong Kong, England, Jersey and Thailand. There have been two trials - one in England and one in Jersey (where I have appeared as Advocate and we created new law relating to common intention constructive trusts). We have recovered millions for our client and (to date) roundly beaten the opposed party (who instructed Taylor Wessing).

What advice would you give rising stars/new lawyers in the private client world?

To specialise early, focus on the area of specialisation, achieve excellence in the relevant area, work as hard, if not harder, than your peers, develop a good range of contacts and remember that the best form of marketing is doing a good job.
