Q&A

What has been the highlight of your practice over the past 12 months?

We are looking after the private wealth requirements of some very large international families requiring a joined up approach from our Ogier Private Wealth teams in Jersey, Cayman, Guernsey and Hong Kong. This supports the investment Ogier has made in Private Wealth to ensure we have the relevant depth and expertise in all our Private Wealth jurisdictions.

What advice would you give rising stars/new lawyers in the private client world?

Get straight to the point and keep advice pragmatic and simple. Clients for the most part do not want an "academic" analysis.

Q&A

What has been the highlight of your practice over the past 12 months?

Seeing the size of our team grow. Walkers has more offshore lawyers than any other firm but has not historically had much of a Channel Islands private client focus, so it has been a great pleasure to be part of something new and exciting.

What advice would you give rising stars/new lawyers in the private client world?

If you come from a traditional tax and trusts background, try to get involved early on with both some corporate work and on the more contentious side. Both of these will stand you in good stead later on in your career when you have become too expensive to be doing this for the first time!

What is your favourite quote?

"If you can't explain something clearly, then you haven't understood it well enough" is a great one for private client lawyers. I think it is one of Albert Einstein's. I also rather like "If you can keep your head when all about you are losing theirs, it's just possible you haven't grasped the situation". That one I believe is from Jean Kerr. Maybe not one to take quite as seriously but a former colleague of mine, Phil le Cornu, used to have it up on his wall and it would always get a smile!

Q&A

What has been the highlight of your practice over the past 12 months?

Preparing a new family constitution for a high net worth individual. It was an interesting and exciting project from the initial meetings with the principal and his advisers right through to the completion some months later. One hopes that the final document will serve the family well for many generations to come.

What advice would you give rising stars/new lawyers in the private client world?

Do not be afraid to ask questions.

Q&A

What has been the highlight of your practice over the past 12 months?

Being involved in some of the most important and high-profile trust litigation in Jersey, including Re Z Trusts (in which the Jersey court is developing an insolvency regime for trusts and as most recently been in the Court of Appeal), B and C –v- Virtue Trustees (Switzerland) AG (in which the Court of Appeal clarified the law of rectification) and M –v- W (which concerns an ongoing application by a beneficiary to remove the protector of a very valuable trust).

What advice would you give rising stars/new lawyers in the private client world?

"Three things:
1. Be ready to learn something new every day.
2. Never assume anything. Assumption is the mother of all mistakes.
3. Think independently and trust your instincts."

What is your favourite quote?

"If you think hiring a professional is expensive, wait till you hire an amateur." - Unknown

Q&A

What has been the highlight of your practice over the past 12 months?

Our team at Carey Olsen has been fortunate to have been involved in a range of challenging trust matters from the non-contentious to the overtly hostile, some involving modest values and others measured in the billions. Several are now making their way through the Court process and will develop the law in Jersey and may be influential beyond. The quality of the financial services business conducted in Jersey allows us as lawyers to enjoy stimulating work and valued relationships with our trustee, protector, settlor and beneficiary clients.

What advice would you give rising stars/new lawyers in the private client world?

The advice I would give to rising stars, new lawyers and indeed anyone involved in the financial services industry is to be ready to adapt to change and to continue their learning at all stages throughout their career. Political and financial uncertainty as well as legal and regulatory change will remain a reality for the foreseeable future if not the rest of our working lives.

"In the business world, the rearview mirror is always clearer than the windshield." Warren Buffett

Q&A

What has been the highlight of your practice over the past 12 months?

A general highlight for me is helping clients to achieve practical, commercial and efficient resolutions to their disputes, and assisting clients with resolving problematic issues before they escalate.

More specifically, I have been involved in a number of trust applications where the Royal Court of Jersey has set aside trusts and/or transfers into trusts on the grounds of mistake, therefore preventing significantly adverse tax consequences from arising.

What advice would you give rising stars/new lawyers in the private client world?

Provide excellent customer service – listen to clients' needs and (if an institution) understand their business. Be proactive – where possible, seek to identify potential problems and point clients towards solutions. Maintain up-to-date technical knowledge – keep abreast of recent developments in your area.
