What has been the highlight of your practice over the past 12 months?

The pandemic has been a great leveller, and has brought us closer to our clients. We’ve all had more time to speak to each other and share personal experiences. I think we will come out of the current situation with more personal and deeper relationships.

How did you get into private client?

In my career, this has meant moving away from “standard structures” (I dislike that term and concept in the Private Wealth sphere!) and becoming the go-to person for bespoke solutions. By natural extension, this has given me the opportunity to get involved with UHNW families and their advisors.

What advice would you give rising stars/new lawyers in the private client world?

Get to know the clients and understand their needs, then think about the structure. Not the other way around – that’s a common mistake

What is your favourite quote?

The pessimist sees difficulty in every opportunity. The optimist sees the opportunity in every difficulty.

When the restaurants reopen, where would you like to go?

I can’t wait to go back to Octopus in Guernsey, or any of the Relais de Venise restaurants in London!

What has been the highlight of your practice over the past 12 months?

I advised on and represented a high profile private client in respect of the rectification of a trust set up as part of his pre US residency planning and which had failed to meet the requirements to qualify as a foreign non grantor trust with very substantial tax consequences in excess of $50million for the client. We were successful in pushing the boundaries and reframing the approach to rectification resulting in a successful rectification with retrospective effect giving effect to the client’s original intention and avoiding the adverse tax consequences. I have been advising on the establishment of a philanthropic foundation to support the empowerment of women in the developing world through the use of technology and I have also been advising a family office in connection with social impact investments in biotech and health technology. I have advised and assisted in the restructuring and redomiciliation of a private trust company and more than 50 underlying companies holding assets in excess of 5bn across 5 jurisdictions to Guernsey.

How did you get into private client?

I moved to Guernsey 12 years ago and joined Carey Olsen’s fiduciary team who already had a market leading practice advising private clients and professional trustees. I have assisted in growing the practice in particular in the region of family offices and have built up strong relationships with trust professionals both on and off island and have the privilege of being trusted adviser to many of them.

Do you have any outside interests or hobbies?

I enjoy playing tennis whenever workloads and family commitments allow. Travel and food adventures.

What has been the highlight of your practice over the past 12 months?

Completing a large, complex trust restructuring that had been in the planning stages for a number of years. It was the culmination of a busy year at the end of which I was promoted to Counsel which I was very proud of.

What has been the highlight of your practice over the past 12 months?

Acting as Trustee in securing a Blessing from the Grand Court of the Cayman Islands for a Momentous Decision for the distribution of high value and complex trust assets under Shari'a Law to the Settlor's named heirs who formed part of a wider beneficial class of beneficiaries - AA v. BB & Colin Shaw (as amicus curiae). Chief Justice Smellie noted that 'The Trustee has arrived not simply at a rational decision, but one which follows very careful, deliberation and inquiry....an approach which may be described as a "textbook" approach to the issues.'

How did you get into private client?

I have worked in the fiduciary industry in Guernsey since 1986 and been fortunate to work on very large family structures throughout my career

What advice would you give rising stars/new lawyers in the private client world?

Work hard. Love what you do with passion and enthusiasm to progress. Take advantage of all development opportunities. I have worked with great people and my advice would be to surround yourself with excellence. Asking for help and learning from mistakes is a strength not a weakness.

Horse-riding, sunny holidays, reading and spending time with my family.

What has been the highlight of your practice over the past 12 months?

Bringing the Villa d’Este to the homes of the private client community during the pandemic, in hosting our Butterfield X David Sanger webinar series. The political topics David touched upon were very timely and spoke to a diverse audience.

How did you get into private client?

Strangely enough, through insolvency. I previously had a career as an insolvency practitioner with KPMG. When I arrived in Guernsey, I needed a change and I’ve been with Butterfield ever since.

Do you have any outside interests or hobbies?

Open-water long distance swimming.

When the restaurants reopen, where would you like to go?

I would like to repeat the lunch Butterfield had at Smiths of Smithfield with Mr. Zirinis and Ms. Maurice in 2018. It seems like a lifetime ago now…

What has been the highlight of your practice over the past 12 months?

Using the statutory Saunders v Vautier provisions in Guernsey to collapse an investment trust structure in circumstances where a power to add beneficiaries existed. Not only did the case provide welcome clarification of statute but it also posed questions on the wider interpretation of the common law 'rule' of relevance to other common law jurisdictions.

What advice would you give rising stars/new lawyers in the private client world?

Be responsive. Your technical ability will be quickly forgotten if you cannot deliver on the client's objectives promptly and efficiently.

What has been the highlight of your practice over the past 12 months?

A lengthy hearing relating to whether or not Guernsey recognises the rule against reflective loss and, if so, whether or not it applies within the trust context.

How did you get into private client?

My first involvement came via trust litigation whilst working in the Cayman Islands on the Esteem and Jahre litigations.

What advice would you give rising stars/new lawyers in the private client world?

There is no substitute for taking the time to get to know and understand your client's drivers in any given situation: only then will you really be able to move matters forward.

I am President of Guernsey's Chamber of Commerce and a part-time lecturer on Civil Litigation for the Guernsey Bar.
