Q&A

What has been the highlight of your practice over the past 12 months?

Successfully running a pro bono case which led to a fundamental change in the Cayman Islands probate legislation. Being involved in the legislative changes and having the law named in memory of the deceased for her family (my clients).

How did you get into private client?

I started my professional life as a barrister at Chancery Commercial Chambers in London, so private client work was always a natural part of my practice.

What advice would you give rising stars/new lawyers in the private client world?

Be a civilised opponent. If we all do that, then our profession will be the enjoyable vocation that it is supposed to be. The alternative is not acceptable.

What is your favourite quote?

"The harder you work, the luckier you get." Michael Bloomberg.

Do you have any outside interests or hobbies?

I’m the Chairman of the Cayman Islands branch of the International Wine and Food Society and I recently passed my level 2 sommelier qualification. To balance out the food and wine, I am a keen long distance runner and CrossFitter.

When the restaurants reopen, where would you like to go?

Taikun, the Japanese restaurant at the Ritz Carlton hotel.

The technical quality and variety of instructions. Not only are clients more sophisticated and recognise the need to plan and restructure but the level of regulation in many areas has highlighted the fact that practitioners must be forward looking and able to quickly adapt.

What advice would you give rising stars/new lawyers in the private client world?

Believe in your ability and be humble. Humility is the key to relationships in the private client world.

"The future belongs to those who believe in the beauty of their dreams." Eleanor Roosevelt.

Q&A

What has been the highlight of your practice over the past 12 months?

I very much enjoy the cut and thrust of litigation. In the past year I have been part of a team that rushed into court to obtain an urgent interim proprietary injunction reliant on a complex self-dealing claim against a fiduciary involving investment fund products and structures. The conversion of that work into a full claim and ultimately a successful conclusion for my client was enormously satisfying.

What advice would you give rising stars/new lawyers in the private client world?

Contentious private client work is challenging but extremely fulfilling. Hit the books and don’t ever be afraid to ask a “stupid” question as these present the best learning opportunities

Q&A

What has been the highlight of your practice over the past 12 months?

Working with Holland and Knight in the US to set up trusts for a UHNWI, which will pass to charity on his death. After his death, we will have to set up a full structure in Cayman with office and staff, with a board to run it for 10 years. Client has chosen to move here for the private wealth services, but top-class philanthropic structure is now here. Spent time stress testing the structure through counsel for open lines of attack to protect it for the settlor’s wishes after his death in foreign courts.

How did you get into private client?

I did economics as an undergraduate and I was considering a career in the City, but I didn’t want to do straight finance. Even before getting into law, I worked at Moore Stephens in private client. As an in- house solicitor in the private team – I was told “if you’re looking for 1. Dealing with people 2. Draft documents 3. Numeracy side of tax, then do private client.” I did my training contract, then the rest was history.

What advice would you give rising stars/new lawyers in the private client world?

Never judge a book by its cover. You never know when what looks like a really weird or unimportant client inquiry will turn into a massive and very interesting matter. It is always worth spending a few minutes on any inquiry because some gems really come out of nowhere. High Net Worth clients often keep a low profile and just because someone is not smartly dressed or has an odd email address, it does not mean they still can’t be your next billionaire client.

What is your favourite quote?

“I intend to live forever, or die trying.” Groucho Marx.

Do you have any outside interests or hobbies?

Very keen swimmer. Running. Jazz enthusiast.

Q&A

What has been the highlight of your practice over the past 12 months?

I have advised and appeared successfully as leading counsel on three significant Beddoe applications for the trustee of the Stingray Trust, two of which were hotly contested, and one of which involved the court granting a Beddoe order retrospectively, which appears to have had no precedent in any reported case. The matter is a multi-jurisdictional cross-border matter with proceedings currently ongoing in three jurisdictions. I was also named amongst the Citywealth Top 100 Trust Litigators in 2020.

How did you get into private client?

I’ve always been involved in litigation from the early 2000’s. Even though I have a general commercial litigation practice, I was the associate assigned to the trust litigation matters. I was involved in Re M surrounding mental capacity in the mid 2000’s and AB v AB Junior, which sparked my interest. Morven McMillan joined us as a specialist private client practitioner who then led the practice. When Morven left in 2015, that was when I took over the leadership over the private client work in the Cayman office, which is now the primary practice for me.

What advice would you give rising stars/new lawyers in the private client world?

This area of the law is as challenging as it is intellectually rewarding. You will have the opportunity to work among some of the brightest lawyers in the world both on the contentious side and on the advisory side. Embrace the opportunity, as success in this field will invariably be recognised as a major achievement.

What is your favourite quote?

"I may be wrong, and often am, but I never doubt." Sir George Jessel.

Do you have any outside interests or hobbies?

I am the President of Cayman Cricket – I don’t know if it’s a hobby anymore, as it’s a lot of work! I am also the Chairman of the Law Reform Commission in Cayman. They both take up a lot of my time. I try my hand at golf too. I also really enjoy camping across the world.

When the restaurants reopen, where would you like to go?

Agua – I live above it! I also really like Eduardo’s Italian and Morgan’s in Cayman.

Semi-contentious Trusts (i.e. a number of applications to the Court for directions on a range of matters)
Non-contentious international trusts and private client advisory work (work with a number of Cayman and international trustees and other intermediaries/advisors on a number of matters).

Q&A

What has been the highlight of your practice over the past 12 months?

My practice is 60/40 between contentious and non-contentious trust work. I have been very lucky to work on a number of high profile confidential trust matters requiring Court applications/directions/relief and work with a number of leading counsel on these matters (and regularly appear on matters where other leading trust practitioners in Cayman appear). In the last 12 months I have been involved in matters requiring a range of relief: Public Trustee v Cooper; Benjamin orders; Beddoe relief and relief to resolve the ambiguity/construction of a trust instrument. I also act for a number of Cayman trust companies and international trust companies on a number of advisory matters. It is this mix of interesting advisory/Court work over the past 12 months that has been my highlight.

What advice would you give rising stars/new lawyers in the private client world?

Work hard, play hard. Be straightforward, with clients, colleagues, courts and opponents alike. Integrity is an absolute prerequisite.

What is your favourite quote?

“However clever and learned a lawyer you may be, it means nothing, unless you also have humanity and common sense” Cicero ( attr.)

Do you have any outside interests or hobbies?

Interest in most sports, participating and viewing. I competed in a famous multisport event in New Zealand - the Coast to Coast World Championships in 2007 and 2008 (and made the finish line both times in c.16 hours). I have also previously represented the Guernsey Men's touch rugby team at the European Touch Rugby Championships in Bristol, 2010. I now enjoy beach runs on Seven Mile Beach and spending time with my little boy, Freddie.

When the restaurants reopen, where would you like to go?

Q&A

What has been the highlight of your practice over the past 12 months?

I have a good balance of non-contentious private client and trust dispute work which makes each day challenging, varied and rewarding. Highlights from this last year have included acting as an expert providing BVI trust law advice in US proceedings, and also providing Cayman trust law advice in London arbitration proceedings. On the non-contentious side, I have worked with a large European family, liaising with their Swiss based family office and dealing with complex trust restructuring, diverse asset classes, governance issues, philanthropic considerations and regulatory work.

How did you get into private client?

By having good mentors at the various law firms I have worked at along the way. Plus, I’m not afraid of dealing with family dynamics.

What advice would you give rising stars/new lawyers in the private client world?

To remain personable, and don't be afraid to think laterally.

What is your favourite quote?

“Without continual growth and progress, such words as improvement, achievement, and success have no meaning,” Benjamin Franklin.

I enjoy running and open-water swimming – not to an amazingly high standard, but I enjoy it! I also have 5 dogs – so lots of walking.

What has been the highlight of your practice over the past 12 months?

We have been involved in several reported cases in Cayman this year. We have had two that stand out and reinforce the capacity of the Cayman court to deal with complex family trust situations. Additionally, in response to COVID, we have set up a specific Cayman Islands charitable foundation company to assist in Cayman’s response.

How did you get into private client?

I spent the first ten years of my career at the Bar in England and Wales, in Lincoln’s Inn. When I was a junior, I did a broad range of chancery work, but gradually veered into private client, trust and estates.

What advice would you give rising stars/new lawyers in the private client world?

Strive to make a human connection with your clients, be yourself, work hard and do the best job you can for your clients, make sure you keep your sense of humour at all times and keep things in perspective. The rest will take care of itself.

What is your favourite quote?

"You will make all kinds of mistakes; but as long as you are generous and true, and also fierce, you cannot hurt the world or even seriously distress her." Winston Churchill.

Do you have any outside interests or hobbies?

Keeping fit! I love the theatre and have a play reading group, which we I am a member of. I also enjoy competing in sporting events for charity.

When the restaurants reopen, where would you like to go?

In Cayman, the restaurant Bacaro. The food is great, it has a fabulous view and the atmosphere is fun.
