What has been the highlight of your practice over the past 12 months?

Adjusting to the different challenges that COVID-19 has presented. Our business traditionally thrives off face-to-face contact with clients, so to be able to adapt to a new model and actually increase client interaction has been fantastic. I don’t see client travel disappearing entirely, however it is clear that remote, digital meetings will comprise a larger part of what we do going forward, and that resonates with the next generation of our clients in terms of mitigating our carbon footprint.

How did you get into private client?

I began my career as a Management Trainee with a local bank here in Bermuda, which gave me the opportunity to experience various aspects of finance. Trusts intrigued me, given the strong legal aspect required and I haven’t looked back since. That was 26 years ago.

What advice would you give rising stars/new lawyers in the private client world?

Be engaged and listen. Be responsive, but with your own conviction. A client may not always like what you have to say, but they should respect it (especially if you are proven correct).

What is your favourite quote?

Out of adversity comes opportunity.

Do you have any outside interests or hobbies?

I find myself talking to lawyers a lot… I like golf too.

When the restaurants reopen, where would you like to go?

My wife and I have our local here in Bermuda (Blu restaurant) which thankfully we are able to visit since the original lockdown period ended. Once we are able to travel again we will most likely visit one of our favourite restaurants in Edinburgh―Castle Terrace.

Getting Butterfield through COVID. We actually received a Global Finance Outstanding Crisis Leadership award for our community outreach and management of the business during the pandemic.

How did you get into private client?

I began my career at Chemical Bank in their Private Banking Group… and the rest is history.

What advice would you give rising stars/new lawyers in the private client world?

Focus on emerging trends, particularly ESG and NextGen.

Do you have any outside interests or hobbies?

I’ve won five national championships in sailing. I also know how to run a dairy farm (it’s in the family!)

Less (no) travel, and being able to enjoy the beautiful experiences that Bermuda has to offer.

How did you get into UHNWI work?

My father was a Trust Officer early in his career. He spoke well of the job. I had stopped listening to him years ago, but this stayed with me, and I followed him into it.

What advice would you give rising stars/new lawyers in the private client world?

Read industry-related articles, and meet as many peers as you can.

Do you have any outside interests or hobbies?

Sailing and Trap & Skeet shooting; Bermuda is good for both. I also have guitars that I sometimes pick-up and try to play. I don't have much opportunity for downhill skiing anymore.

When the restaurants reopen, where would you like to go?

Restaurants are open in Bermuda. But when we can travel again, I mostly miss a pint of English Bitters in a proper pub. It could be any pub with a good selection, but if I had to pick one it would be the Bag O’ Nails near Victoria Station. I also enjoy Vietnamese food, which is not available here.

What has been the highlight of your practice over the past 12 months?

I have been involved in the Law Reform Committee and Bermuda trust focus group, where we meet monthly as a Think Tank. As a firm we have been collaborating more in ways we can assist Bermuda in improving the economy and how to attract more family offices. I’ve also been involved in more charity work due to COVID19.

How did you get into private client?

I thought I wanted to be an accountant, so I got an economics degree and went to work for PWC in the summers, later full time. Suffice to say, it wasn’t for me. I then went to law school and then articled in London and loved the private client group.

What advice would you give rising stars/new lawyers in the private client world?

Stay current – the world is constantly changing as are the needs of private clients. Do not stagnate. Keep ahead of the game. Try to adapt to new innovations and technologies. Constantly learn, take new seminars and courses. Retain connections and network.

What is your favourite quote?

“You can never be overeducated or overdressed." Oscar Wilde.

Do you have any outside interests or hobbies?

Yoga and pilates and three children. I am also a member of La Chaine, a wine/ foodie group.

Mickey’s on the beach in the summer. Boler. The Loren. Hamilton Princess restaurants, too!

The honest answer is that I loved trusts at Oxford. I didn’t set out in my career to be a trust lawyer!

Put client service above all else and subject to this, make every effort to write for publications as often as possible and no less than twice per year.

What has been the highlight of your practice over the past 12 months?

Helping to settle several large, complex international family trust restructurings and disputes. Bermuda has seen a host of such complex matters and I have had the opportunity to be involved in many of the disputes involving high net worth individuals in matters covering important and ground breaking points of law.
Published highlights have included the 2017 Supreme Court of Bermuda case, Meritus Trust Company Limited v Butterfield (Bermuda) Limited which confirmed that outgoing trustees do not have the right to retain assets in respect of known actual or contingent liabilities or to require a contractual indemnity unless expressly provided for. I have also recently represented a trustee in the first significant matter in Bermuda addressing the issue of ante and post nuptial settlements in divorce proceedings involving trust assets. Other highlights have included In the Matter of an Application for Information About a Trust in the Supreme Court of Bermuda which dealt with the restrictive veto power to withhold information from beneficiaries as well as In the Matter of the Estate of PQR which addressed the validity of a forfeiture clause in a will consisting of assets worth multi million dollars. It is always a highlight, as in the latter case, to be able to provide clients with the support they need to face difficult emotional as well as complex legal hurdles.

What advice would you give rising stars/new lawyers in the private client world?

Know your industry inside out. Network with attorneys from all the main jurisdictions. Keep up to speed with developments (both case law and legislative development) and take the time to understand the psychology of generational family wealth.
