Family governance

What has been the highlight of your practice over the past 12 months?

I have successfully built my practice in family governance by acting as a trusted advisor of the family to advise the family on all matters that the family is concerned about. I acted as a lead counsel to advise an expatriate blended family in Hong Kong on a challenging wealth transition process due to an unexpected demise of the patriarch. The matter involved complex issues in multiple practice areas (trust, probate and estates, family governance, family business, corporate and finance) and jurisdictions (Hong Kong, BVI, Australia and UK). We worked closely with the family and the board of the family business to analyse and resolve some common and some competing interests among the parties. My role involved leading and coordinating a team of advisors to the family as well as providing specific legal and family governance advice. The matter involved determining the validity of a BVI family trust, handling cross-border probate and estate administration in Hong Kong, Australia, UK and BVI, facilitating family arrangements for global estate distribution, setting up a family council, drafting a family constitution, safeguarding the life interest of the widow, developing policies for parties wanting to join the family business and for transferring family business ownership and negotiating the shareholders agreement with the minority shareholders of the family business. It was a very challenging matter as many different issues needed to be addressed at the same time, the blended family didn’t have any experience in working together to make decisions and the family was still struggling to cope with deep grief for the sudden loss of the patriarch.
