What has been the highlight of your practice over the past 12 months?

Deirdre focuses on trust and succession planning, wills drafting, family governance, as well as pre-marital asset protection planning. She advises high-net-worth individuals and families, private banks, as well as institutional trustees on wealth protection structuring. Over the past 12 months, an interesting matter which Deirdre was involved in was advising a bank on potential lending to a beneficiary of a family trust. The beneficiary is also the chairman of the family company held by the trust, and has shareholding in the family company outside of the trust structure. The potential conflicts of interest issues were considered, as well as the duties and liabilities of trustee of the family trust when exercising its investment/voting powers.
Deirdre was also involved in drafting trust deed templates (including discretionary trust, VISTA trust, STAR trust and employee share ownership trust) for a bank trustee. A new area which Deirdre is working on is advising institutions on the implications of the TCSP (trust and corporate service provider) licensing regime as well as the significant controller’s regime. Both regimes commenced in Hong Kong on 1 March 2018.
